Οι αντιπροσωπίες της Ιταλίας, της Σλοβακίας και του Ηνωμένου Βασιλείου ψήφισαν κατά. Οι αντιπροσωπίες συμφώνησαν να δημοσιευθεί το αποτέλεσμα της ψηφοφορίας. Έγιναν οι ακόλουθες δηλώσεις: ΙΤ: «Η Ιταλία (παραπέμποντας στο άρθρο 4 παράγραφος 3 του κανονισμού (ΕΚ) αριθ. 1049/2001) αντιτίθεται στη δημοσιοποίηση όλων των εξεταζόμενων εγγράφων, ιδίως του εγγράφου 4, διότι θα υπονομευθεί η διαδικασία λήψης αποφάσεων που δεν έχει ακόμα ολοκληρωθεί. Πέραν τούτου το έγγραφο δεν κατέστη διαθέσιμο στις αντιπροσωπίες κατά τις διαπραγματεύσεις και οι πληροφορίες που καταγράφονται στο εν λόγω ανεπίσημο έγγραφο δεν στάθηκε δυνατό να επιβεβαιωθούν και θα μπορούσαν να είναι παραπλανητικές.» 5012/16 ΔΙ/ακι/ΙΑ 1 DG F 2C LIMITE EL
ΣΚ: «Η Σλοβακική Δημοκρατία δεν συμφωνεί με το εν λόγω σχέδιο απάντησης. Η Σλοβακική Δημοκρατία είναι της άποψης ότι η εξαίρεση δυνάμει του άρθρου 4 παράγραφος 3 του κανονισμού (ΕΚ) αριθ. 1049/2001 θα πρέπει να ισχύσει δεδομένου ότι βρίσκεται ακόμα σε εξέλιξη η διαδικασία λήψης αποφάσεων όσον αφορά το αντίστοιχο σχέδιο νομοθετικής πράξης. Παρόλο που η Σλοβακική Δημοκρατία δεν αντιτίθεται στη γνωστοποίηση του εγγράφου με τα σλοβακικά σχόλια, ανησυχεί ιδιαιτέρως όσον αφορά τη γνωστοποίηση του δελτίου ιστορικού με τις θέσεις όλων των αντιπροσωπιών.» ΗΒ: «Το Ηνωμένο Βασίλειο αντιτίθεται στη δημοσιοποίηση και των πέντε αναφερόμενων εγγράφων και παραπέμπει στο άρθρο 4 παράγραφος 3 του κανονισμού (ΕΚ) αριθ. 1049/2001: Προκειμένου περί εγγράφου που συντάχθηκε από ένα θεσμικό όργανο για εσωτερική χρήση ή που έχει παραληφθεί από ένα θεσμικό όργανο, και το οποίο σχετίζεται με θέμα επί του οποίου δεν έχει αποφασίσει, το εν λόγω θεσμικό όργανο αρνείται την πρόσβαση εάν η γνωστοποίηση του εγγράφου θα έθιγε σοβαρά την οικεία διαδικασία λήψης αποφάσεων, εκτός εάν για τη γνωστοποίηση του εγγράφου υπάρχει υπερισχύον δημόσιο συμφέρον. Ένα θεσμικό όργανο αρνείται την πρόσβαση σε έγγραφα που περιέχουν απόψεις για εσωτερική χρήση, ως μέρος συζητήσεων και προκαταρκτικών διαβουλεύσεων εντός του σχετικού θεσμικού οργάνου, ακόμη και αφού έχει ληφθεί η απόφαση, εάν η γνωστοποίηση του εγγράφου θα έθιγε σοβαρά την οικεία διαδικασία λήψης αποφάσεων, εκτός εάν για τη γνωστοποίηση του εγγράφου υπάρχει υπερισχύον δημόσιο συμφέρον. Οι διαπραγματεύσεις συνεχίζονται και το μέτρο δεν έχει ακόμα εγκριθεί. Κατά την άποψη του Ηνωμένου Βασιλείου η γνωστοποίηση των διαπραγματευτικών θέσεων των κρατών μελών δεν βοηθά και πιθανόν να υπονομεύσει σημαντικά τις διαδικασίες λήψης αποφάσεων του Συμβουλίου, καθώς τα κράτη μέλη δεν θα ήταν πρόθυμα να συμμετάσχουν σε διεξοδική και ειλικρινή συζήτηση και να καταρτίσουν έγγραφα για τις Ομάδες αν υπάρχει περίπτωση οι θέσεις και τα έγγραφά τους να δημοσιοποιηθούν. Πέραν τούτου μπορεί να θεωρηθεί ότι οι απόψεις που εκφράζονται για έναν φάκελο ισχύουν για τις διαπραγματευτικές θέσεις σε άλλους φακέλους, όταν η πολιτική έχει οριζόντιες επιπτώσεις. Ακόμα κι αν τα κράτη μέλη δεν υποβάλουν έγγραφα, οι πολιτικές τους και οι πολιτικές των θεσμικών οργάνων μπορούν να επηρεαστούν από έγγραφα που υποβάλλουν άλλοι. Τα ζητήματα αυτά υπερισχύουν του δημόσιου συμφέροντος για δημοσιοποίηση. Επιπλέον το Ηνωμένο Βασίλειο δεν γνωρίζει περιπτώσεις δημοσιοποίησης παρόμοιων εγγράφων εργασίας στο παρελθόν.» 5012/16 ΔΙ/ακι/ΙΑ 2 DG F 2C LIMITE EL
Καλείται συνεπώς η Επιτροπή των Μόνιμων Αντιπροσώπων να εισηγηθεί στο Συμβούλιο, κατά την προσεχή του σύνοδο: - να συμφωνήσει, υπό τα σημεία «Α», σχετικά με το συνημμένο σχέδιο απάντησης - να αποφασίσει να δημοσιεύσει το αποτέλεσμα της ψηφοφορίας. ΠΑΡΑΡΤΗΜΑ DRAFT REPLY ADOPTED BY THE COUNCIL ON... TO CONFIRMATORY APPLICATION 24/c/02/15, made by email on 18 December 2015, pursuant to Article 7(2) of Regulation (EC) No 1049/2001, for public access to a number of documents related to negotiations regarding the Trade Secrets Directive The Council has considered this confirmatory application under Regulation (EC) No 1049/2001 of the European Parliament and of the Council of 30 May 2001 regarding public access to European Parliament, Council and Commission documents (OJ L 145 of 31.5.2001, p. 43) and Annex II to the Council s Rules of Procedure (Council Decision 2009/937/EU, Official Journal L 325, 11.12.2009, p. 35) and has come to the following conclusion: 1. The applicant refers to "minutes of all meetings of the Intellectual Property Working Party and the Intellectual Property Attachés at which the Commission's Proposal for a Directive on the protection of undisclosed know-how and business information (trade secrets) against their unlawful acquisition, use and disclosure was discussed, including the positions of the Member States concerned" and to "preparatory documents for the meetings, and any documents which were discussed within the meetings". 2. In its reply of 8 December 2015 to the applicant's request dated 14 October 2015, the General Secretariat of the Council gave either full access or access excluding only personal data to 20 documents, and identified five further documents of which two were partially and three were fully withheld. 3. In the confirmatory application dated 19 December 2015, the applicant reiterates the initial application, as far as it was unsuccessful, with the exception of the redaction of personal data, which is not challenged by the confirmatory application. 5012/16 ΔΙ/ακι/ΙΑ 4 ΠΑΡΑΡΤΗΜΑ DG F 2C LIMITE EL
Full access to the documents partially or fully withheld in the initial phase 4. In the initial phase, the General Secretariat thus has withheld (a) comments on the four-column document from Slovakia of 22 July 2015, (b) Greek observations of 22 July 2015 and (c) a four-column draft documents of 22 July 2015 with Belgian comments, as well as parts of the following documents: (d) a background fiche and (e) a four-column table of 1 July 2015 with comments from Slovenia. 5. In doing so, the General Secretariat has relied on the exception contained in Article 4(3), first subparagraph, of Regulation 1049/2001. This exception applies where disclosure of the document would seriously undermine the institution's decision-making process on condition that there is no overriding public interest in disclosure. 6. The Council has carefully considered the confirmatory application. It has re-assessed the request for access in full consideration of the principles underlying Regulation No 1049/2001, the aim of ensuring the widest possible public access to documents and the fact that wider access should be granted to documents in cases where the institutions are acting in their legislative capacity. 7. Taking into account the current state of play in the legislative procedure concerned, it has come to the conclusion that on balance the public's interest in disclosure outweighs the existing concerns in relation to the protection of the decision-making process, and that therefore full public access to the requested documents should now be granted, with the exception of personal data in one document as explicitly accepted by the applicant (see point 3 above). 8. The Council notes, however, that the present positive decision is based on the facts of the concrete confirmatory application concerned, and under no circumstances it can constitute a precedent for the future, since each application shall be assessed and judged on its own merit, pursuant to the established practice of the Council. 5012/16 ΔΙ/ακι/ΙΑ 5 ΠΑΡΑΡΤΗΜΑ DG F 2C LIMITE EL
Alleged failure to appropriately record proceedings of the Intellectual Property Working Party and the Intellectual Property Attachés 9. The applicant alleges that the Council has failed to appropriately record discussions that have taken place in the Intellectual Property Working Party and among Intellectual Property Attachés. 10. Discussions at working party level have a very informal nature, and no formal decisions are taken there. Due to this, the practice is to only draft records that are necessary or at least useful for further discussions. Accordingly, some preparatory bodies draft "outcome of proceedings" documents, and some do not, exclusively based on the concrete need of delegations in a given preparatory body at a given time. The practical approach in the file concerned has been to only note aspects that are useful for further discussions and to then reflect them in subsequent working documents, but to refrain from recording any aspects that have no such usefulness. The Council considers that given the nature of discussions at working party level this approach is far from "arbitrary or unpredictable", as the applicant seems to imply, but on the contrary simply very practical common sense. 11. The Council thus cannot see any failure to appropriately record proceedings at the meetings concerned. Other documents covered by the initial application 12.
