However ENVI claimed exclusive competence with regard to some of the annexes. CoP decided on 6 October to approve the recommendation by the CCC, except for selected provisions of Annex I. For the parts of Annex I related to limits on contaminants, ENVI is granted exclusive competence. On 13 July 2016, IMCO received a letter from JURI requesting association under Rule 54 with shared competence for Art 1(5), Art 4 and Art 9(2). By written procedure, IMCO Coordinators agreed on 5 September 2016 to reject the JURI claim for Rule 54 and to propose a JURI opinion under Rule 53 instead. The Chair has subsequently drafted a response letter to JURI and the CCC, however JURI reiterated its request for Rule 54. IMCO coordinators decided to agree on JURI s request for geoblocking, provided IMCO can obtain shared competence for article 13 and associated recitals (37-38- 39) on the copyright file. European Agenda for the collaborative economy (ZGV) COM(2016)0356 Main: IMCO The Communication was referred to the IMCO Committee by the Referrals unit. Three Committees request association under Rule 54 on the INI: TRAN, ITRE and EMPL. TRAN argumentation: two of five key sectors of col. eco of TRAN competence (i.e. accommodation (short-term letting) and passenger transport). ITRE argumentation: col. eco as element of the information society - ITRE competent for information society, ITRE had rule 55 on DSM, cross-sectorial nature of the Communication - not only one committee should be responsible for the file in EP, ITRE as competent for businesses and SMEs and for innovation; EMPL argumentation: issues of labour law, definition of worker, and employment relationship; PV\1110961.docx 7/21 PE595.401

IMCO Committee requested authorisation to draft an INI report under Rule 52 on 28 June 2016. The IMCO letter also responds to the TRAN request and rejects it. The IMCO letter stresses that, given the still evolving nature of collaborative economy and its nascent state, the COM Communication does not focus on any specific sector where collaborative economy services have developed over time, but examines identified questions and issues across sectors with an accent on provision of services through collaborative economy as such. The IMCO and ITRE Chairs met to discuss this conflict and other pending conflicts of competence with ITRE. An agreement was found that would grant ITRE Rule 54 with shared competence on issues related to innovation (i.e. with focus on how to best ensure that legislative environment allows for innovation, and promotes industry growth, in particular with regard to supporting innovation in technological hubs & technological incubators, and emergence of new business models; and monitoring of obstacles to innovation and emergence of new business models; ) Negotiations with EMPL were concluded with an agreement granting EMPL Rule 53+. However, EMPL coordinators rejected the agreement between the Chairs and decided to address the matter to the CCC. Proposal for a Regulation of the European Parliament and of the Council establishing a Union certification system for aviation security screening equipment (CM/TSN) Proposal for a Regulation of the European Parliament and of the Council on cross-border parcel delivery services - COM(2016) 285 final - (BM/PC) 2016/0236(COD) COM(2016)491 final Main: TRAN Opinions: LIBE, IMCO (Rule 54) 2016/0149 (COD) COM(2016)0285 Main: TRAN Opinion : ITRE IMCO, The proposals was referred to TRAN, opinion by LIBE and IMCO with recommendation for Rule 54. The objective of the proposal is to set up an EU certification system based on typeapproval and issuance of certificate of conformity by manufacturers. The system would facilitate the proper functioning of the internal market through free movement of the aviation security screening equipment according to the principle of mutual recognition, which will help increase the capacity of this industrial sector. The proposal does not concern the performance requirements for the equipment itself - these are provided for by Regulation (EC) 300/2008 on the implementation of common standards on aviation security - for which TRAN was in the lead and LIBE gave an opinion. It rather intends to create an effective certification system where compliance with these performance requirements will have to be demonstrated by accredited testing laboratories applying a common testing methodology and will give rise to a certification that will be valid in all EU Member States. On these premises and seen the precedents, such as the recent proposal on Type approval of Motor Vehicles (COM(2016)0031 2016/0041(COD)) the coordinators decided at their meeting of 26 September to challenge the referral and claim full competence on the proposal. Following the referral of this Regulation proposal to TRAN, the IMCO Chair addressed a letter on 21 June 2016 to the CCC Chair, challenging the referral as erroneous and requesting the appointment of IMCO as lead committee. The mission will focus on meetings with the WTO and the UN to discuss how international cooperation affects standards, public procurement and consumer protection in the EU. dialogue is part of the Standardisation Communication the Commission launched in June 2016. The report is expected to be adopted by the Commission in March 2017 and will aim to assess the implementation of the Annual Union Work Programme, the ICT standardisation priorities, the Joint Initiative and the development of services standards. The Commission will be invited to attend the IMCO Committee meeting in April to discuss the report. The inter-institutional dialogue will allow for the full involvement of the EP and will feed into the drafting of the Annual Union Work Programme 2018. Coordinators agreed to invite the Commission to the Committee meeting in April and to involve the ITRE committee on the ICT Standardisation priorities, as appropriate. 10.2 Joint JURI-AFCO working group on Better Law-making - IMCO representative (BM) The JURI and AFCO committees set up a joint working group on the interpretation and implementation of the newly concluded Interinstitutional Agreement on Better Lawmaking in order to prepare their own-ini (rule 55).
