Cigarette Smuggling The Coordinators agreed unanimously with Mr Staes' proposal to request a drafting of a working document which summaries the findings of the briefing papers on tobacco agreements and the workshop on cigarette smuggling with the aim to indicate recommendations for the next steps to be taken and charge him as draftsman of the working document. D. The establishment of a new reserve list for the OLAF Supervisory Committee Coordinators discussed Commissioner Šemeta s reply to the chairman s letter of 14 November. The procedure for establishing a new list for future members of the OLAF-SC and for establishing a reserve list raised a number of legal questions. Coordinators decided to consult Parliament s Legal Service on those. The Members of the Court of Auditors shall be appointed for a term of six years. In accordance with Article 286(2) of the TFEU the Council, after consulting the European Parliament shall adopt the list of Members drawn up in accordance with the proposals made by each Member The following candidate has been proposed by the Austrian Government: Oskar Herics. Appointments to the ECA are submitted to Parliament's plenary on the basis of a report from CONT, which takes into account, among other circumstances, Article 286(1) of the TFEU: "the Members of the Court of Auditors shall be chosen from among persons who belong or have belonged in their respective States to external audit bodies or who are especially qualified for this office. Their independence must be beyond doubt." A. Procedure According to Rule 108 (1) of Parliament's Rules of Procedure, "candidates nominated as Members of the Court of Auditors shall be invited to make a statement before the committee responsible and answer questions put by members. The committee shall vote on each nomination separately by secret ballot." I. Questionnaires and statements In preparation for the hearing, the candidate has been asked to answer the questionnaire prepared by CONT. The Rapporteur Mr Mulder highlighted the need for a continuous developing of the overall effectiveness of the control pyramid and the supervision of the reporting of EU delegations and to simultaneously refine the methodology on the residual error rate on closed operations to better assess their financial impact. For budget support, the Rapporteur welcomed the strengthening of the risk management framework and the stronger focus placed on accountability and the application of eligibility conditions are met within both the development policy step and political dialogue stage with recipient countries. As regards the activities of the Investment Facility, the Rapporteur welcomed the EIB's new results measurement framework for better assessing projects' expected results while recalling the necessity to keep regular alignment with Union's development policies objectives and to ensure Union's visibility by projecting Union's values. The committee held an exchange of views with the Secretary Generals (or the Representatives) of the institutions (except the Council) on the 9 January 2014. The Vice-President/High Representative Catherine Ashton was invited to CONT on the 21 January for an exchange of views. Due to a last minute commitment in Geneva, she was unable to attend the CONT meeting and was represented by Mr David O'Sullivan, Chief Operating Officer of the EEAS. Mr O'Sullivan covered a wide range of issues related to staff management, including grading, training and retirement, the Special Representatives, procurement in both headquarters and delegations and the budgetary improvements implemented by the Service in the different areas. The presentation was followed by a debate with MEP s. The questions to the Council were sent on the 15 January to the European Commission following the Parliament's discharge resolution of 17 April 2012 in its paragraph 21, which recalled that if the Council would continue refusing to cooperate with the Parliament, the questionnaire from CONT Members would be submitted to the Commission. The Chair and the Rapporteur received a letter from EC Vice-President Maros Sefcovic on 23 January stating that all institutions should cooperate to ensure the smooth functioning of the discharge procedure in full respect of the relevant provisions in the Treaty and in the related secondary law. The answer to the Council's questionnaire by the Commission would infringe the autonomy of that institution to implement its own section of the budget as foreseen Article 55 of the Financial Regulation. The Council's questionnaire on the financial year 2012 thus remains unanswered. The Rapporteurs prepared their reports based on the documents submitted, the exchange of views in committee and the replies given by all the institutions - except the Council - to the questionnaires. As the Council continues not to reply to the questions submitted, the Rapporteur for the Council's discharge proposes in his draft to postpone the discharge. ARE TOOLS IN PLACE TO MONITOR THE EFFECTIVENESS OF EUROPEAN SOCIAL FUND SPENDING ON OLDER WORKERS? (COURT OF AUDITORS SPECIAL REPORT 25/2012) On Tuesday 21 January 2013, CONT discussed the draft report on the tools in place to monitor the effectiveness of European social fund spending on old workers. The Rapporteur pointed out his concern on the weaknesses in the implementation of the European Social Fund, in particular the lack of data from Member States with regard to old workers and the absence of indicators to assess the effectiveness of the actions addressing the needs of old workers or whether the money is well spent. The Rapporteur emphasised the need, for the programming period 2014-2020, to establish special indicators to make clear the causal link between the actions undertaken and the goals defined, to implement a better monitoring system to correct the programmes if objectives established are not reached and to set up an efficient system of data collection related to old workers. The Committee on Employment and Social Affairs (EMPL) delivered on 24 January 2014 an opinion on this CONT report for which Ms Danuta Jazlowiecka was appointed Rapporteur. The deadline for amendment was 31 January and 56 amendments were tabled in English. A shadows meeting was organised on 12 February to discuss the amendments. The Rapporteur proposed some compromise and oral amendments to include the contributions coming from the other political groups which do not undermine the double objective of keeping the opinion as concise as possible and giving a valuable input to the Council. The Rapporteur wants to ensure that the Commission's proposal is improved by introducing proper control procedures of EPPO's activity, including the dismissal of the European Public Prosecutor, guaranteeing enhanced involvement of the national authorities in the protection of financial interest complementing the EPPO's action and the collection of evidence is properly ruled. At the same time, the EPPO's mission should be limited to the protection of the financial interests and its competence shouldn't therefore be extended. The Rapporteur considers that the EC proposal has many loopholes that are to be addressed by the Parliament in its interim report. The main Committee, LIBE, decided to produce an interim report. According to Rule 50 of the EP Rules of Procedure, CONT will deliver an opinion to the interim report of LIBE with exclusive competence to issues relating to the protection of the financial interests of the Union in sensu stricto and the cooperation with OLAF or its future role, in view of the envisaged transfer of staff and resources to EPPO. He underlines that the total indicative resources deemed necessary for the seven European Research Joint Undertakings that have so far been established by the Commission, under Article 187 of the Treaty for their period of existence amounts to EUR 21 793 000 000. The Rapporteur, also, reiterates the invitation for the Court of Auditors to comprehensively analyse the JTIs and the other joint undertakings in a separate report in light of the substantial amounts involved and the risks presented therein. European Parliament and the Council on the Protection of the European Union's financial interests - Fight against fraud - and with the Director-General of OLAF, Giovanni Kessler, on the thirteenth report of the European Anti- Fraud Office for 2012. The Rapporteur welcomed major recent initiatives undertaken by the Commission, following the request of the European Parliament leasing to the definition of a new European legislative landscape in anti-fraud policy notably with the proposals concerning the fight against fraud against the Unions financial interests and the European Public Prosecutor's Office (EPPO). She examined the state of play in terms of fraudulent and non-fraudulent irregularities reported and their financial impact in various domains of the EU interventions and welcomes the good results of the VAT reform launched in 2011 that has already provided better protections against VAT fraud. The Rapporteur also emphasised the remaining efforts to be undertaken in particular with regards to (i) the performance assessment of national perception systems of receipts, (ii) the current diversity of approaches between Member States concerning the detection of fraud and (iii) the lack of accuracy and exhaustiveness of the data which prevent the comparison and the achievement of an objective assessment of the extent of fraud in Member States. Furthermore, the Rapporteur welcomed both the reorganisation of OLAF with the first improvements in OLAF governance and the first report of the Commission dedicated to the anti-corruption policy and its suggestions to further design new EU dispositions in this field. The Rapporteur finally invited the Commission to pursue its efforts concerning cigarette smuggling. The deadline for tabling amendments is on 25 February 2014.
