Country: Greece Date Table Completed: March 2009 Person(s) completing Table: Short introduction on transposition context Directive 94/62/EC on packaging and packaging waste was transposed in the Greek national legislative system through Law 2939/2001 (OJ A 179/6.8.2001) in 2001. Transposition took place after the deadline provided for in Directive 94/62/EC. Directive 2004/12/EC amending Directive 94/62/EC was transposed through Joint Ministerial Decision () 268/469/2007 (OJ 286B/2.03.2007) regarding the amendment of quantitative targets on recovery and recycling of packaging waste, according to article 10 of Law 2939/2001 (OJ A 179), as also of other provisions of this Law, in harmonization with the provisions of Directive 2004/12/EC amending Directive 94/62/EC on packaging and packaging waste. This entered into force on the 2 March 2007, again after the transposition deadline set by the Directive. In general, the transposition of Directive 2004/12/EC follows a literal, word by word, transposition approach. The only actual problems have to do with the delay in transposition, causing also the absence of quantitative targets set for the 30 th of June 2001, since the first legislative act on packaging (Law 2039/2001) entered into force in August 2001, namely after this deadline. Article 1 Art. 1.1 Directive 94/62/EC is hereby amended as follows: 1. the following subparagraphs shall be added to point 1 of Article 3: The definition of packaging shall be further based on the criteria set out below. The items listed in Annex I are illustrative examples of the application of these criteria. (i) Items shall be considered to be packaging if they fulfil the abovementioned definition without prejudice to other functions which the packaging might also perform, unless the item is an integral part of a product and it is necessary to contain, support or preserve that product throughout its lifetime and all elements are intended to be used, consumed or disposed of together. As a priority, the following items shall be addressed: CD and video cases, flower pots, tubes and cylinders around which flexible material is wound, release paper of self-adhesive labels and wrapping paper. 2. Article 4 shall be replaced by the following: Article 4 Prevention 1. formation of packaging waste taken in accordance with Article 9, other preventive measures are implemented. Such other measures may consist of national programmes, projects to introduce producer responsibility to minimise the environmental impact of packaging or similar actions adopted, if appropriate in consultation with economic operators, and designed to bring together and take advantage of the many initiatives taken within Member States as regards prevention. They shall comply with the objectives of this Directive as defined in Article 1(1). 2. The Commission shall help to promote prevention by encouraging the development of suitable European standards, in accordance with Article 10. The standards shall aim to minimise the environmental impact of packaging in accordance with Articles 9 and 10. These measures can include the development of an environmental indicator regarding packaging, which could make the prevention of packaging more simple and more effective c) Between paragraphs 2 and 3, a new paragraph 3 is inserted, therefore the existing paragraph 3 is renumbered as 4. The new paragraph 3 reads as follows: 3. In the Alternative Management Programs it is possible that producer responsibility is introduced as a further preventive measure in order to further minimize the damaging environmental impacts of packaging by determining that the development of an environmental indicator regarding packaging could be one of these additional preventive measures. Milieu Ltd 4/18 The Directive s provision sets examples of other measures and does not as such require transposition. Greece has opted to provide specifically for the possibility of introducing producer responsibility in the Alternative Management Programs as a further preventive measure. Art. 1.3 appropriate, present proposals for measures to strengthen and complement the enforcement of the essential requirements and to ensure that new packaging is put on the market only if the producer has taken all necessary measures to minimise its environmental impact without compromising the essential functions of the packaging. 3. Article 6 shall be replaced by the following: Article 6 Recovery and recycling 1. In order to comply with the objectives of this Directive, Member States shall take the necessary measures to attain the following targets covering the whole of their territory: (a) no later than 30 June 2001 between 50 % as a minimum and 65 % as a maximum by weight of packaging waste will be recovered or incinerated at waste incineration plants with energy recovery; (b) no later than 31 December 2008 60 % as a minimum by weight of packaging waste will be recovered or incinerated at waste incineration plants with energy recovery; (c) no later than 30 June 2001 between 25 % as a minimum and 45 % as a Art. 2 par. 1 of Art. 2 of Art. 2 of 1. EOEDSAP shall take every necessary measure in the framework of its competencies and in compliance with the targets and principles of article 1 and 4 of Law 2939/2001, for the achievement of the following targets: (a) no later than 31 December 2005 at least 50 % as a minimum by weight of packaging waste will be recovered or incinerated at waste incineration plants with energy recovery; (b) no later than 31 December 2011 60 % as a minimum by weight of packaging waste will be recovered or incinerated at waste incineration plants with energy recovery (c) no later than 31 December 2005 between 25 % as a do not need to be transposed The Directive s requirement is transposed as an obligation of the EOEDSAP to take every necessary measure for the achievement of the targets. Greece has made use of the derogation provided for in the new Article 6(7.)(b) of Directive 94/62/EC, by postponing the achievement of the targets set in paragraph 1(a) to the maximum of the deadline provided, namely, 31 December 2005. The transposing provides for the minimum target of 50%. The fact that no maximum target is specified is not deemed to constitute a conformity problem. Council Regulations (EEC) No 259/93, (EC) No 1420/1999 and Commission Regulation (EC) No 1547/1999, shall only count for the achievement of the obligations and targets of paragraph 1 if there is sound evidence that the recovery and/or recycling operation took place under conditions that are broadly equivalent to those prescribed by the Community on the matter. 3. Member States shall, where appropriate, encourage energy recovery, where it is preferable to material-recycling for environmental and cost-benefit reasons. This could be done by considering a sufficient margin between national recycling and recovery targets. 4. Member States shall, where appropriate, encourage the use of materials obtained from recycled packaging waste for the manufacturing of packaging and other products by: (a) improving market conditions for Art. 3.3. point b of Art. 3.3. point a of Κοινότητα σύµφωνα µε τους Κανονισµούς του Συµβουλίου (ΕΟΚ) αριθ. 259/93 και (ΕΚ) αριθ. 1420/1999, όπως ισχύουν και τον Κανονισµό (ΕΚ) αριθ. 1547/1999 της Επιτροπής Ε.Κ., όπως ισχύει, προσµετρώνται στην κάλυψη των υποχρεώσεων και στόχων της παραγράφου 1 µόνον εάν υπάρχουν σαφείς αποδείξεις ότι η αξιοποίηση ή/και ανακύκλωση έλαβε χώρα σύµφωνα µε τις σχετικές διατάξεις της κείµενης νοµοθεσίας και κάτω από συνθήκες ισοδύναµες, σε γενικές γραµµές, µε εκείνες που ορίζει η σχετική εθνική και κοινοτική νοµοθεσία. β) Στο πρώτο εδάφιο της παραγράφου 2, µετά την περίπτωση (ii), προστίθενται οι περιπτώσεις (iii) και (iv) που έχουν ως εξής: «iii) της ανάκτησης ενέργειας, όπου ενδείκνυται και είναι προτιµότερη από την ανακύκλωση υλικών, για περιβαλλοντικούς λόγους και για λόγους κόστους ωφέλειας. Στη περίπτωση αυτή θα πρέπει να προβλεφθεί επαρκές περιθώριο µεταξύ εθνικών στόχων ανακύκλωσης και εθνικών στόχων αξιοποίησης.» 3. The Greek adds on the phrase in accordance with the relevant provisions of the in force and makes reference to conditions broadly equivalent to those prescribed also by relevant national. Not later than 31 December 2007, the European Parliament and the Council shall, acting by qualified majority and on a proposal from the Commission, fix targets for the third five-year phase 2009 until 2014, based on the practical experience gained in the Member States in pursuit of the targets laid down in paragraph 1and the findings of scientific research and evaluation techniques such as lifecycle assessments and cost-benefit analysis. This process shall be repeated every five years. 6. The measures and targets referred to in paragraph 1 shall be published by the Member States and shall be the subject of an information campaign for the general public and economic operators. 7. Greece, Ireland and Portugal may, because of their specific situations, namely respectively the large number of small islands, the presence of rural and mountain areas and the current low level of packaging consumption, decide to: (a) attain, no later than 30 June 2001, lower targets than those fixed in paragraphs 1(a) and (c), but shall at least attain 25 % for recovery or incineration at waste incineration plants with energy recovery; (b) postpone at the same time the attainment of the targets in paragraphs Art. 2 of 3. Art. 5 (2) of Law 2939/2001 states, inter alia, that EOEDSAP develops and implements programs for the alternative management of packaging, which include, inter alia, measures for the information of the consumer and end user in accord with Art.19 of the Law. - No Greece has made use of the derogation provided for in this article. Nevertheless, regarding the targets set for 30 June 2001, no such targets have been set, given also the fact that the first actual legislative act on packaging was the Law 2939/2001, which entered into force on 6 August 2001 and therefore after the deadline of 30 June 2001 1. 8. The Commission shall, as soon as possible and no later than 30 June 2005, present a report to the European Parliament and the Council on the progress of the implementation of this Directive and its impact on the environment, as well as on the functioning of the internal market. The report shall take into account individual circumstances in each Member State. It shall cover the following: (a) an evaluation of the effectiveness, implementation and enforcement of the essential requirements; (b) additional prevention measures to reduce the environmental impact of packaging as far as possible without compromising its essential functions; (c) the possible development of a packaging environment indicator to render packaging waste prevention simpler and more effective; (d) packaging waste prevention plans; (e) encouragement of reuse and, in particular, comparison of the costs and benefits of reuse and those of recycling; (f) producer responsibility including its financial aspects; (g) efforts to reduce further and, if appropriate, ultimately phase out heavy metals and other hazardous substances in packaging by 2010. The report shall address the issues in paragraph 8 as well as other relevant issues in the framework of the different elements of the Sixth Environmental Action Programme, in particular the thematic strategy on recycling and the thematic strategy on the sustainable use of resources. The Commission and the Member States shall, as appropriate, encourage studies and pilot projects concerning points 8(b), (c), (d), (e) and (f) and other prevention instruments. 10. Member States which have, or will, set programmes going beyond the maximum targets of paragraph 1 and which provide to this effect appropriate capacities for recycling and recovery shall be permitted to pursue those targets in the interest of a high level of environmental protection, on condition that these measures avoid distortions of the internal market and do not hinder compliance by other Member States with this Directive. Σε περίπτωση που ο Ε.Ο.Ε..Σ.Α.Π. καταρτίζει ή πρόκειται να καταρτίσει πρόγραµµα, σύµφωνα µε το οποίο γίνεται υπέρβαση των οριζόµενων στην παρ. 1 (α και β) ποσοτικών στόχων, µε την πρόβλεψη παράλληλα κατάλληλων δυνατοτήτων ανακύκλωσης και ανάκτησης, για µία υψηλού επιπέδου προστασία του περιβάλλοντος, το πρόγραµµα αυτό εγκρίνεται 4. In case that EOEDSAP sets up programmes going beyond the maximum quantitative targets of paragraph 1 and which provide to this effect appropriate capacities for recycling and recovery aiming to pursue a high level of environmental protection, then paragraph 3 of article 10 of Law 2939/2001 is applied. In case that EOEDSAP sets up or intends to set up programmes going beyond the maximum quantitative targets of paragraph 1 (a and b) and which provide to this effect appropriate capacities for recycling and recovery aiming to pursue a high level of environmental protection, then this program is approved through a Decision by the Milieu Ltd 12/18 Obligations addressed to EU institutions do not need to be transposed. EOEDSAP has not made actual use of this provision in order to set programmes going beyond the maximum targets.

Art. 1.4 Member States shall inform the Commission of such measures. The Commission shall confirm these measures, after having verified, in cooperation with the Member States, that they are consistent with the abovementioned considerations and do not constitute an arbitrary means of discrimination or a disguised restriction on trade between Member States. 4. The second part of the Directive s provision is addressed to the Commission. Although the aim is not transposed (namely in order to facilitate collection, reuse and recovery ), the actual obligation is in place, namely that packaging has to indicate the nature of packaging material used on the basis of the relevant Commission Decision. Therefore, the omission of the aim is not considered as a non conformity.
