Όπως γνωρίζετε, βάσει του αρ. 39 της Οδηγίας των Υπηρεσιών από τις αρχές του 2010 θα ξεκινήσει διαδικασία αμοιβαίας αξιολόγησης μεταξύ των Κρατών Μελών για τα αποτελέσματα που έχουν προκύψει από τη διαδικασία καταγραφής και αξιολόγησης του νομοθετικού πλαισίου για τις υπηρεσίες (screening). Στην πρώτη φάση της διαδικασίας αξιολόγησης, τα Κράτη Μέλη θα χωριστούν σε ομάδες (clusters) και οι συζητήσεις θα εστιάσουν κατά κύριο λόγο σε τομείς υπηρεσιών που έχουν κριθεί ως τομείς προτεραιότητας από τα Κράτη Μέλη και την Επιτροπή. Σας ενημερώνουμε ότι η χώρα μας θα είναι στην ίδια ομάδα με το Ηνωμένο Βασίλειο, την Ιρλανδία, τη Ρουμανία και την Κύπρο και επισυνάπτουμε προς ενημέρωσή σας κατάλογο με τους τομείς προτεραιότητας που μας διαβίβασε η Ευρωπαϊκή Επιτροπή. Επίσης, σας διαβιβάζουμε το τελικό υπόδειγμα αυτο-αξιολόγησης (self-assessment template), το οποίο πρέπει να υποβληθεί από όλα τα Κράτη Μέλη στα πλαίσια της διαδικασίας αμοιβαίας αξιολόγησης το αργότερο μέχρι τις 20 Ιανουαρίου, όπως διαμορφώθηκε μετά τις παρατηρήσεις των Κρατών Μελών. SERVICES SECTORS Below you will find a list of important services sectors falling under the Services Directive which have been identified by Member States as priority. When discussing the requirements falling under the mutual evaluation process (both in clusters and plenary meetings) particular attention should be paid to these sectors. Wholesale and retail services should be understood as covering the sale (business to business and business to consumer) of goods (such as consumer products, food, motor vehicles, etc.), as well as services auxiliary to the sale of these goods, such as installation, repair and maintenance services. It should also be understood as covering various types of distribution channels, such as sale via physical stores, sale via mail, television or Internet. Construction and property related services should be understood in a broad manner and cover the activity of construction as such as well as related activities like maintenance and installation services (for instance plumbing, installation and maintenance of heating, electricity or ventilation appliances, installation of doors, windows, etc.), building completion and finishing services (for instance painting, tiling, roofing, carpentry, etc.) or services related to site preparation and demolition. Real estate activities should be understood as covering the services of real estate agents, such as the selling, buying and renting of real estate, as well as other real estate services such as appraising real estate, managing facilities or providing facilities support services (such as cleaning and maintenance). Tourism and related services include the provision of short-stay accommodation (such as hotels or camping grounds), the activities of travel agencies, the activities of tour operators, of reservation services, and of tourist guides. Food and beverage services, including restaurants, event catering and beverage serving activities, such as bars. Services of the regulated professions such as the services of lawyers, accounting, book-keeping and auditing activities, tax consultancy, services of architects and engineers, surveying activities and the services of veterinaries. Business services should be understood as covering services that are used by businesses (B2B) (as inputs) in the context of their operations. They comprise knowledge-intensive services (such as IT-consulting, management consulting, recruitment services, advertising and market research, professional training) as well as operational services (such as 18/12/2009
industrial cleaning, property management, administrative and secretarial services). Private education services such as private universities and language schools. Note: inevitably, activities in a number of these sectors overlap (e.g. engineering services could be seen under construction or under the services of the regulated professions) 18/12/2009
Template self-assessment The self-assessment of the Member State is a summary reflecting the major headlines of the screening results. It therefore does not require you to engage into a detailed description of the content of legislation nor to cover all sectors that have been part of the screening exercise in your country. The aim of the self-assessment is to provide a starting point to the process of mutual evaluation and to assist Member States to comprehend and put into context the results of the screening of legislation in the other Member States. Besides replying to the questions raised in the template you may raise other points which you consider to be of importance in the evaluation process. You should however limit the information you provide to what is relevant for the mutual evaluation process. Keep in mind in particular that aspects of the Directive such as the Points of Single Contact, the electronic procedures or the administrative cooperation (including the changes in legislation required to set them up or make their use possible) are not part of the mutual evaluation process.
1. Which are the main changes in your legislation as a result of the screening process? 2. Which areas, in your view, will benefit most from the aforementioned changes in legislation? 3. In addition to the national level, can requirements covered by the Services Directive be set in your Member State by the regional government, local government and/or professional bodies? If so, please explain (which are the most important areas falling under the regional or local level or under the regulatory role of professional bodies?) and indicate if such requirements have been screened. 4. In order to help obtaining an overview of the most important parts of your Art. 39 reports, could you please indicate the legislation (national or regional legislation only as well as professional bodies) which you have reported via IPM, containing: o Authorisation schemes of a horizontal nature (i.e. applicable to all or to a number of service activities) o The most important authorisation schemes in areas that have been identified as possible priorities for the mutual evaluation (*) or in areas that you consider important o The most important requirements of the kind listed in Art. 15 in areas that have been identified as possible priorities for the mutual evaluation (*) or in areas that you consider important o The most important requirements on multidisciplinary activities of the regulated professions or in the area of certification, technical monitoring, etc. o In relation to Art. 16, requirements which apply specifically to service providers established in other Member States and providing services in your country
o Again in relation to Art. 16, most important authorisation and notification schemes which also apply to service providers established in other Member States and providing services in your country (i.e. those which apply to established as well as to incoming service providers) 5. Have all changes planned as a result of the screening process in your Member State been finally adopted? If no, please indicate the main changes still foreseen, the stage of preparation (e.g. draft adopted by government or draft under discussion in Parliament) and, if possible, the foreseen adoption date.
