Yes, with pleasure. 3) The situation of the remaining goods, i.e. if customs was already paid to release and it will be taken back to my country? There are two options. Permanent import which means all customs duties and VAT is paid on import or alternatively if temporary import, we would lodge a bond to customs thus no duties and taxes are paid on release. Should the client sell the cargo during the show, we would then bring duties to account, bill the exhibitor the duties & VAT in order to liquidate the bond. The bond is a non-refundable bond, thus sometimes it is better to pay the duties on entry and then the client knows what his actual cost is on his products. If he does not sell all the items he can then remove the goods from the country without a problem. 4) List of any prohibited goods The organisation called the International Trade Administration Commission of South Africa ITAC, is responsible for the regulation of goods being imported into South Africa. Their list of items subject to import control measures can be downloaded from their web site: http://www.itac.gov.za/import_measures_page.asp I have attached a copy of the pages form the web site. (See attachment 2) In addition to this list there are also restrictions applicable on Tobacco products, Cosmetics and Medicines and these are regulated by Port Health or the Medical Control Council. 5) List of contractors for setting up the stands: Oasys Innovation is the preferred contractor. To all Members Zero-rate Ruling: VAT Following input from a Member regarding the applicability of the VAT ruling, allowing for the zero-rating of VAT for qualifying international exhibitors, EXSA requested an urgent review of the VAT Ruling issued by SARS on the 6 th September 2012 to confirm our previous ruling in this regard, by EXSA s lawyers (ENS). The advice received is that the new ruling, dated 6 September 2012, withdrew the concession to apply VAT at the rate of zero per cent to the rental of exhibition space. EXSA views this in a very serious light and have engaged with the lawyers to appeal to SARS for clarity on this issue. Importantly the questionability of the ruling is only in respect of the rental of exhibition space. The ruling confirmed that the hire / sale of exhibition services may continue to be zero-rated to those international exhibitors who qualify under the ruling, and the SARS is bound by the ruling in this regard. It is very important that until clarity is obtained from SARS, that VAT at the applicable rate (i.e. 14%) is applied to the rental of exhibition space. Members who have applied the rate of zero per cent to the rental of exhibition space with effect from 6 September 2012 may be held liable for the VAT and possibly penalties and interest if the submissions to the SARS in this regard are not successful, and these members are advised to obtain professional advice in this regard.
