5 «2nd Anticorruption Forum: For a sustainable economy in tobacco sector», was held on Tuesday, February 13th, 2018 at the General Secretariat of Information Systems, in Athens, under the auspices of Transparency International Greece and is endorsed by General Secretariat Against Corruption and Special Sectoral Secretariat for Financial and Economic Crime Unit (SDOE). The main objective of the forum was the wider social issue of illicit trade in tobacco products, as well as the need to address it through fiscal stability and the close cooperation of all stakeholders. According to significant Greek and foreign speakers who participated in the forum, illicit trade of tobacco products affects the economy of Greece, endangering, among other things, several thousands of families currently employed in the supply chain of tobacco. The forum was successful in both presentations and structure of the schedule with significant and meaningful participations.

12 Terens Nikolaos Quick Deputy Minister Of Foreign Affairs Terens - Nikolaos Quick is a well-known journalist, politician and member of the political party INDEPENDENT HELLENES. He is Deputy Foreign Minister, responsible for Greeks Abroad (Diaspora Hellenes), in the coalition cabinet of SYRIZA INDEPENDENT HELLENES. Biography He was born in Thessaloniki on 18 February He started his studies at the Thessaloniki s University of Higher Industrial Studies. But his dreams for a carrier in Journalism and Communication, lead him to studies at Panteion University of Political Science, during the first year of which, he began his journalistic career. He is married to Adamantia Gerosideri and father of three children. Political career In the regional elections of 1986 and 1990,Terens Quick was elected (as a candidate for the Political Party New Democracy ) member of the City Council and deputy Mayor of Athens and in the regional elections of 1994 and 1998, he was elected member and Chairman of the City Council of Palaio Psychiko. In March of 2012, he took the position of Spokesman at the political party «INDEPENDENT HELLENES PANOS KAMMENOS» In the 2012 Greek parliamentary elections, he was counted the top vote-getter for INDEPENDENT HELLENES and elected to the Hellenic Parliament, taking his seat as the parliamentary Spokesman and also the Head of the Defense and Foreign Affairs Policy of the Party. During his parliamentary Service ( ), Terens Quick was elected unanimously, Secretary of the Standing Parliamentary Committee on Greeks Abroad and was a member of the Permanent Standing Parliamentary Committee on Defense and Foreign Affairs, as well as member of the Greek parliamentary group Organization for Security and Cooperation in Europe (OSCE). He was also a member of the Parliamentary Friendship Group with Russia, Japan (he was elected Secretary), Britain and Chile. On the 27th of January 2015, he was appointed Deputy Minister to the Prime Minister, responsible for the coordination of the Government s Work. At the same time, he was also appointed member of the Committee Against Corruption. As from November 2016, he was appointed Deputy Foreign Minister for Greeks Abroad (Diaspora Hellenes).

13 Zafiro (Zefi) Nikolaou, MA, CFE, CSFE Board Member of Transparency International-Greece Zafiro (Zefi) Nikolaou belongs to the upper management of the National Bank of Greece. She began her career in 1986 in the Ministry of Finance and in 1989 was hired in the National Mortgage Bank of Greece, where she worked in serious administration departments. Ιn 1999 (since the merger of the former NMBG with NBG) she joined NBG and for many years she served as senior manager at the loans sector in the Branch Network, where she obtained great experience on financial and credit matters. Since 2011 she has been working on compliance and anti-money laundering issues. Currently, she supervises the Subdivision of Quality Assurance for Products and Services of the Bank, in the Group Compliance and Regulatory Affairs Division. In parallel, she has worked, in the past, as a journalist (political and cultural issues) in newspapers and other media. Mrs Nikolaou is a Certified Fraud Examiner (CFE), and holds Certifications in Customer Service Management (CFSE) and in Compliance (UoA) and Anti-Money Laundering (UoA). She has studied Journalism, and holds a Bachelor s Degree in European Civilization (HOU) and a Master s Degree in Journalism-Communication, specialized in Corporate Communication (OUC). She is a member of the Association of Certified Fraud Examiners (ACFE) and a member of the Association of Compliance Officers in Greece (ASCO). Since October 2017, she is a Member of the Board of Directors of Transparency International-Greece (TI-Greece). Zefi Nikolaou, Board Member of Transparency International-Greece underlined that corruption costs 2 trillion dollars a year worldwide. Only in 2015 is estimated that EU governments have deprived more than 11 billion Euros of tax revenues. 16 Konstantinos Christou General Secretary, General Secretariat Against Corruption (GSAC) Konstantinos Christou was born in Athens. He graduated the Department of Law at Democritus University of Thrace and he is a registered member of Athens Bar Association with scientific expertise in commercial law and financial criminal law. During January of 2016 he was appointed as the Special Secretary of the Special Sectoral Secretariat for Financial and Economic Crime Unit (SDOE) which falls under the Hellenic Ministry of Finance with the task of reorganizing the body, operational support and developing its co-operation with the other auditing bodies. At November of 2016 he was appointed as the General Secretary Against Corruption (GSAC), which falls under the Ministry of Justice, Transparency and Human Rights where his main responsibility is the implementation of the National Strategic Plan Against Corruption and the effective co-ordination between the auditing bodies. He also participates in the Interministerial Committee Against Corruption and in the Anti-smuggling Committee for products with excise duties. Christodoulos Kirtsidis Judge, Thessaloniki Court He graduated from the School of Law and Economics of the Aristotle University of Thessaloniki where he attended the Postgraduate Department of Criminal Law. He joined the judiciary in He served at the Courts of First Instance of Volos, Orestiada, Veria, Thessaloniki, Athens and Kavala and in the Northern Aegean and Thessaloniki Courts of Appeal. He collaborates with the NAPin, in organizing its European programs. Eirini Gialouri General Director Customs Eirini Gialouri, Director General of Customs, has headed the Directorate General of Customs & Excise Duties since August 20, She studied Business Administration at the University of Piraeus. She followed postgraduate studies in Athens University of Economics leading to a master s degree in Public Administration and Policy. She is currently a PhD candidate at the Law School of Athens University on Business Tax evasion as criminal behavior. She was appointed to the Ministry of Finance in 1987, where she serves for twenty-eight years at all levels of the administrative hierarchy. She served as Head of Operational Directorate of Special Affairs of Athens in SDOE, Customs Control Directorate of the Ministry of Finance as well as Deputy Director of E Customs Office of Piraeus. She has represented the Customs Administration in numerous meetings of the European Union, international organizations and initiatives at the international, regional and bilateral levels. She has participated as a national expert in community programs of providing technical assistance to third countries for expertise transfer and adoption of acquis communautaire in view of their accession to the EU. Alongside, she was speaker at conferences and workshops of chambers and professional bodies highlighting the role of customs in facilitating and protecting the legitimate trade. She has also participated as a trainer in specialized training programs for customs officers. Cigarette smuggling OLAF MISSION l to protect the financial interests of the European Union (EU) by investigating fraud, corruption and any other illegal activities; l to detect and investigate serious matters relating to the discharge of professional duties by members and staff of the EU institutions and bodies that could result in disciplinary or criminal proceedings; l to support the EU institutions, in particular the European Commission in the development and implementation of anti-fraud legislation and policies. UNIT B2/Tobacco Sector Activities Current situation of cigarette smuggling to the EU. l Containers.. Based on art. 8 of the EC Reg.883/2013, OLAF deals with investigations and coordination cases. In the fight against cigarette smuggling to the EU, OLAF cooperates closely with the competent authorities in the EU Member States and third countries (Customs, police and judicial authorities) and other Institutions (EUROPOL, EUBAM, SELEC, EUROJUST, etc). OLAF exchanges information with the EU Member States on the basis of the EC Reg. 515/97 and with the third countries on the basis of the Mutual Assistance Agreements on Customs Matters. l Financial gains are enormous (losses estimated to be about 10 billion euro each year - EU/MS taxes and duties) l The EU average of financial losses (import duties, excises and VAT) for one forty foot container is approximately 2 million euro. Threats EU Cigarette producers l Legittimate companies produce cigarettes in the MS, but are part of a criminal organisation which makes false exports of these cigarettes or the cigarettes are exported but with the only aim to smuggled them back to the EU. l OLAF has on going investigations. l Dubai and Far East are still the origin of large amout of contraband cigarettes into the EU, as well as the countries on the EU Eastern Border (Belarus, Ukraine, Moldova). l OLAF has on ongoing initiatives with the Dubai authorities in order to increase their cooperation. l A large number of containers are destined to Libya every year. l African countries, such as Kenia, are the declared destination l of several consignments of cigarettes in transit through the EU.

21 l Cigarette smuggling by sea l Since 2015, ten vessels and their cargo of cigarettes were seized in the EU. l Eight of these vessels had loaded relevant quantities of cigarette in the port of Bar (Montenegro) declaring mainy Libya as destination. l The total amount of cigarettes was around master cases (320 million cigarettes) which represents in termes of Customs and excise duties and VAT protected around 64 million euro. l OLAF ascertained that other vessels, which had loaded cigarettes in the port of Bar have never arrived at the port of destination, mainly Beirut (Lebanon) and Port Said and Alexandria (Egypt) and therefore the cigarettes have never been discharged there. l As an example, on 23/12/2016 the vessel BOMARIS LEGEND,flag Congo IMO n , loaded with master cases of cigarettes, left the port of Bar destined for Beirut. l OLAF has ascertained that: l - the Bomaris Legend has never called Beirut and the consignee has never ordered the cigarettes; l -during the period 28/12/2016 at 10:27 UTC to 1/1/2017 at 10:54 UTC (four days), the Bomaris Legend kept sailing very close to Malta south coast, from West to East and back making frequent stops. l Then the route followed by the Bomaris Legend has not any commercial/financial justification. In the Black Sea large amount of cigarettes are loaded onto vessels mainly in the port of Batumi and Poti (Georgia) and in Ukraine. In September, 2017 an operation coordinated by OLAF allowed the Romanian Border Police to seize 5 million Toros brand "cheap white" cigarettes, which were being smuggled on-board a ship sailing under the Slovenian flag in the Black Sea. The searches carried out during the operation also led to the arrest of four individuals. Cigarette smuggling by air Cigarette smuggling to the EU by air is increasing both as a cargo and transported by passengers. In July 2017, OLAF provided the Spanish Customs with information on a suspicious airfreight cigarette shipment from the United Arab Emirates (UAE), destined for Barcelona El Prat Airport. As a result, 1.8 million Manchester cigarettes were seized. OLAF also helped halt smuggled cigarettes arriving into the European Union by plane. Working closely with individual Member States, several separate operations took place mainly at the airports of Amsterdam (The Netherlands), Frankfurt (Germany) Milan (Italy) and Madrid (Spain), resulting in the combined seizure of more than 1 million cigarettes. Illegal cigarette production in the EU. The illegal production of cigarettes in the EU is still very active. Recently two illegal cigarette factories have been dismantled in The Netherlands and in Italy. In the framework of the Hercules III programme on technical assistance, OLAF cooperated with the Dutch Fiscal Information and Investigation Service (FIOD), raiding an illegal production factory and subsequently arresting 14 people. Initial estimates by the Dutch authorities point to roughly 5 million cigarettes seized, preventing the loss of circa EUR 1 million in customs, VAT and excise duties. Large amount of tobacco disappears from the legal market to be used in the illegal cigarette production.. OLAF RESULT IN 2017 The intelligence developed by OLAF in the fight against cigarette smuggling to the EU and the consequent close cooperation with the competent services in the EU Member States led to the seizure of almost master cases of cigarettes ( cigarettes) which correspond to 47 full containers of cigarettes. (All the cigarettes mentioned below and seized in the MS are included in this figure). The loss prevented to the EU and Member States budgets in terms of Customs and excise duties and VAT can be estimated in 94 million. (Customs duties can be estimated at 8,5million ). The most relevant examples of this cooperation. Seizure in Belgium. In May, with OLAF's support, Belgian Customs seized a shipment carrying 90 million cheap whites cigarettes from Egypt at the Port of Antwerp. Seizure in Spain. A shipment arriving at the Port of Valencia was supposed to be misdeclared as plastic shoes. Based on intelligence from OLAF, nine people were arrested and nine million American Legend cigarettes were seized. Seizure in Greece OLAF developed intelligence which led to ascertain that cigarette smugglers had tried to mislead track-and-trace efforts by swapping transport documents with another container allegedly carrying plastic bags. In July Greek authorities then seized 14 million President cigarettes in Thessaloniki. The close collaboration with both EU Member States and with third countries was key to uncovering this modus operandi.. Seizure in Lithuania. Persistence proved to be a key factor when OLAF and the Lithuanian customs started surveillance of a suspicious shipment in early May. The information gathered through the Anti-Fraud Transit Information System (ATIS) led the Romanian Border Police, whom the two bodies were cooperating with, to seize 1.2 million Marble cigarettes and arrest six individuals at the end of June. Prevention. OLAF works also on the identification of cigarette consignments in third countries which maybe destined for the EU contraband market. During summer, OLAF had an intense cooperation with the Ukrainian State Fiscal Service which, thanks to a swift exchange of information, seized more than 12.5 million Regina cigarettes and yet another 2.5 million cheap whites at the EU external border. Ò Μείωση στην οικονοµική δραστηριότητα της νόµιµης αλυσίδας εφοδιασµού µε συνέπεια την Ò απώλεια θέσεων εργασίας. Ò Επιπτώσεις στην πολιτική περιορισµού του καπνίσµατος. Ò Επιπτώσεις στην δηµόσια υγεία από τα προϊόντα καπνού που δεν παράγονται σύµφωνα µε τους ευρωπαϊκούς κανονισµούς. Ò Τροφοδότηση παραοικονοµίας και οργανωµένων παράνοµων κυκλωµάτων. Ò Δηµιουργία µαύρης αγοράς καπνικών που δεν φορολογείται. ΣΥΝΕΠΕΙΕΣ ΣΤΗΝ ΔΗΜΟΣΙΑ ΥΓΕΙΑ Ò Επιπτώσεις, όµως, υπάρχουν και στη δηµόσια υγεία, καθώς από έγγραφο µε επιστηµονικές αναλύσεις του Γενικού Χηµείου του Κράτους (Χηµική Υπηρεσία Σερρών), που εστάλη στη Γενική Γραµµατεία Διαφάνειας, προκύπτει ότι σε λαθραία τσιγάρα διαπιστώθηκε υπέρβαση των νόµιµα αποδεκτών τιµών σε µονοξείδιο του άνθρακα µέχρι 100%, στην πίσσα 70% και τη νικοτίνη 15%. Ò Συγκεκριµένα, διαπιστώθηκε ότι χρησιµοποιείται καπνός χαµηλής ποιότητας και συχνά µόνο απορρίµµατα (σκόνες και τρίµµατα) και άλλα άχρηστα παραπροϊόντα της καπνοβιοµηχανίας, µε συνέπεια να γίνεται απαραίτητη η χρήση χηµικών προσθέτων αγνώστου είδους και προέλευσης από τους παρασκευαστές των προϊόντων αυτών. ΣΥΝΕΠΕΙΕΣ ΣΤΗΝ ΔΗΜΟΣΙΑ ΥΓΕΙΑ Ò Μάλιστα, τα λαθραία προϊόντα είναι συχνά επιβαρηµένα ακόµα και µε βαρέα µέταλλα, µη επιτρεπτά αγροτοχηµικά προϊόντα, τρίχες ζώων, περιττώµατα ποντικιών, φτερά, σχοινιά, κορδόνια, κοµµάτια πλαστικού και ξένες ύλες!!! Τα φίλτρα, δε που χρησιµοποιούνται, συνήθως, είναι κατώτερης ποιότητας από αυτά των νόµιµων προϊόντων. Αποστολή Το Τµήµα Φορολογικής Αστυνόµευσης είναι αρµόδιο για την έρευνα και τη δίωξη των εγκληµάτων και παραβάσεων που αφορούν ιδίως: α. στη φορολογική νοµοθεσία ακόµα και στις περιπτώσεις που δεν συνιστούν αξιόποινες πράξεις και β. στην τελωνειακή νοµοθεσία και ειδικότερα σε λαθρεµπορικές δραστηριότητες ιδιαιτέρως µεγάλης αξίας. Στις περιπτώσεις που από την Διεύθυνση Οικονοµικής Αστυνοµίας διενεργείται έλεγχος για την βεβαίωση παραβάσεων της φορολογικής και τελωνειακής νοµοθεσίας, προκαταρκτική εξέταση ή προανάκριση για οικονοµικά εγκλήµατα που υπάγονται στην αρµοδιότητα της δεν ισχύει το : } φορολογικό, } τελωνειακό } τραπεζικό, } χρηµατιστηριακό ή } επιχειρηµατικό απόρρητο. 31 } Το Σύστηµα Μητρώων Τραπεζικών Λογαριασµών και Λογαριασµών Πληρωµών (ΣΜΤΛ & ΛΠ) αποτελεί ένα ηλεκτρονικό σύστηµα που παρέχει στους χρήστες του τη δυνατότητα να εισάγουν και να διαβιβάζουν αιτήµατα παροχής πληροφοριών και στοιχείων που αφορούν σε τραπεζικά δεδοµένα. } Αίτηµα 01: Ύπαρξη και Υπόλοιπα Καταθετικών Λογαριασµών. Το Αίτηµα 01 ζητάει από τα υπόχρεα πιστωτικά ιδρύµατα για συγκεκριµένο ΑΦΜ, κατάσταση που να παρουσιάζει αναλυτικά τα στοιχεία των καταθετικών λογαριασµών στους οποίους συµµετέχει ή συµµετείχε κατά την τελευταία 10ετία, µαζί µε τα τρέχοντα υπόλοιπά τους. ), και } Αίτηµα 02 που αφορά κινήσεις καταθετικών λογαριασµών. Στο άρθρο 155 του Ν. 2960)2001 ορίζεται ότι λαθρεµπορία είναι: α) η εντός του τελωνειακού εδάφους εισαγωγή ή εξ αυτού εξαγωγή εµπορευµάτων υποκειµένων σε δασµούς, φόρους και λοιπές επιβαρύνσεις που εισπράττονται στα Τελωνεία, χωρίς τη γραπτή άδεια της αρµόδιας Τελωνειακής Αρχής ή σε άλλο από τον ορισµένο παρ' αυτής τόπο ή χρόνο, β) οποιαδήποτε ενέργεια, που αποσκοπεί να στερήσει το Ελληνικό Δηµόσιο ή την Ευρωπαϊκή Ένωση των υπ' αυτών εισπρακτέων δασµών, φόρων και λοιπών επιβαρύνσεων από τα εισαγόµενα ή εξαγόµενα εµπορεύµατα, και αν ακόµη αυτά εισπράχθηκαν κατά χρόνο και τρόπο διάφορο εκείνου που ορίζει ο νόµος. } 1. Η λαθρεµπορία κατά το άρθρο 157 του Ν. 2690/2001 τιµωρείται: α) Με φυλάκιση τουλάχιστον έξι (6) µηνών. Εάν όµως το αντικείµενο της λαθρεµπορίας δεν έχει σηµαντική αξία και προορίζεται για ατοµική χρήση ή ανάλωση του υπαίτιου, το ελάχιστο όριο της ποινής µειώνεται στο ένα έκτο. β) Με φυλάκιση τουλάχιστον ενός (1) έτους: - εάν διαπράχθηκε καθ' υποτροπήν, - εάν διαπράχθηκε ενόπλως ή υπό τριών ή περισσοτέρων µαζί, - εάν οι δασµοί, φόροι και λοιπές επιβαρύνσεις που στερήθηκε το Δηµόσιο ή η Ευρωπαϊκή Ένωση ανέρχονται τουλάχιστον στο ποσό των τριάντα χιλιάδων (30.000) ευρώ και άνω και - εάν ο υπαίτιος µεταχειρίσθηκε ιδιαίτερα τεχνάσµατα. γ) Με κάθειρξη, εάν οι δασµοί, φόροι και λοιπές επιβαρύνσεις που στερήθηκε το Δηµόσιο ή η Ευρωπαϊκή Ένωση υπερβαίνουν το ποσό των εκατόν πενήντα χιλιάδων ( ) ευρώ. } Βιοµηχανοποιηµένα καπνά, στα οποία επιβάλλεται Ειδικός Φόρος Κατανάλωσης (Ε.Φ.Κ.), θεωρούνται: (Α 94 Ν. 2960/2001) α) τα τσιγάρα β) τα πούρα και τα πουράκια, γ) ο λεπτοκοµµένος καπνός που προορίζεται για την κατασκευή χειροποίητων (στριφτών) τσιγάρων, δ) τα άλλα καπνά για κάπνισµα. Άρθρο 53 Α του Ν. 2960/01 } Επιβάλλεται φόρος κατανάλωσης ( 1 Α.58 Ν. 4389/2016, σε ισχύ από ), στα εισαγόµενα από τρίτες χώρες, προερχόµενα από άλλα Κράτη-Μέλη της Ευρωπαϊκής Ένωσης ή εγχωρίως παραγόµενα προϊόντα, ως ακολούθως: } α) Στα υγρά αναπλήρωσης, τα οποία περιέχονται στα ηλεκτρονικά τσιγάρα ή σε ειδικούς περιέκτες επαναπλήρωσης ή φιαλίδια µίας χρήσης που προορίζονται να ενσωµατωθούν σε συσκευές ηλεκτρονικού τσιγάρου. } Διάρκεια έρευνας: 8 µήνες } Διακίνηση λαθραίων τσιγάρων από εγκληµατική οργάνωση αποτελούµενη από επτά (7) άτοµα (έξι οµογενείς από την Αρµενία, Γεωργία και Καζακστάν και ένας αλλοδαπός υπήκοος Βουλγαρίας) } Ανάπτυξη εγκληµατικής δραστηριότητας σε περιοχές της Αττικής αλλά και σε διεθνές επίπεδο (Ιταλία). } Πραγµατοποιήθηκαν έρευνες σε εγκαταστάσεις και γραφεία των εµπλεκοµένων σε πολλές περιοχές της Αττικής } Τα µέλη του κυκλώµατος συνελήφθησαν και κατηγορήθηκαν για σύσταση και συµµετοχή σε εγκληµατική οργάνωση, λαθρεµπορία, παράβαση του νόµου περί όπλων και πλαστογραφία, ενώ τρεις (3) εξ αυτών προφυλακίστηκαν. } Καταδικάστηκαν µε υπερδεκαετή κάθειρξη Πρωτοδίκως } Πληροφορίες για εισαγωγή από Κίνα µεγάλων φορτίων µε λαθραία τσιγάρα σε εµπορευµατοκιβώτια, που διοχετεύονταν στη συνέχεια τόσο στην ελληνική αγορά όσο και στο εξωτερικό (Ιταλία). } Το φορτίο εισάγονταν στην Ελλάδα και φυλάσσονταν αρχικά σε κεντρική αποθήκη στην περιοχή των Θρακοµακεδόνων Αττικής. Στη συνέχεια από εκεί, µέσω µελών του κυκλώµατος, διοχετεύονταν τόσο σε εγχώριους λιανοπωλητές στο κέντρο της Αθήνας, όσο και εξάγονταν σε Ευρωπαϊκές χώρες (Ιταλία) µε ψευδή παραστατικά µέσω διεθνών µεταφορικών εταιρειών. } Ειδικότερα, µετά τον εκτελωνισµό και την αρχική αποθήκευση, η διακίνηση του φορτίου στην εσωτερική αγορά πραγµατοποιείτο από το κύκλωµα µε φορτηγά αυτοκίνητα, κλειστού τύπου (βαν), στα οποία είχαν τοποθετήσει πλαστές πινακίδες κυκλοφορίας, που αντιστοιχούσαν σε αυτοκίνητα ίδιας µάρκας, τύπου και χρώµατος } Από την άλλη, το φορτίο µε τα λαθραία τσιγάρα, για την εξαγωγή του από την Ελλάδα, συγκαλύπτετο, µέσω ψευδών συνοδευτικών εγγράφων, σε φορτία ξυλείας πατωµάτων «LAMINATE», µε προορισµό την Ιταλία. } Μετά από πολύµηνη έρευνα (επιτηρήσεις µελών του κυκλώµατος, άρσεις απορρήτου τηλεφωνικών επικοινωνιών κλπ), πραγµατοποιήθηκε συντονισµένη ευρείας κλίµακας αστυνοµική επιχείρηση, σε διάφορες περιοχές της Αττικής, κατά την οποία συνελήφθησαν όλα τα µέλη της οργάνωσης, ενώ παράλληλα διενεργήθηκαν έρευνες (κεντρική αποθήκη και λοιποί αποθηκευτικοί χώροι) όπου βρέθηκαν και κατασχέθηκαν πακέτα λαθραίων τσιγάρων ( τεµάχια) και 540 πακέτα καπνού διαφόρων εµπορικών σηµάτων (GOLD MOUNT foul flavour - GOLD CLASSICR.G.D. filter cigarrettes - R.G.D. Magnum κλπ). } Οι διαφυγόντες δασµοί, τους οποίους στερήθηκε το Δηµόσιο και η Ευρωπαϊκή Ένωση από τη λαθραία διακίνηση των κατασχεθέντων καπνικών προϊόντων ανέρχονται στο ποσό των ,11. } πακέτα λαθραίων τσιγάρων ( τεµάχια) και 540 πακέτα καπνού } Χρηµατικό ποσό 1.644,30 } Πέντε (5) όπλα διαφόρων τύπων (πιστόλια, περίστροφα, κυνηγετικά) } Πλήθος φυσιγγίων διαφόρων διαµετρηµάτων } Διόπτρες νυκτός } Ηλεκτρονικοί υπολογιστές } Πλήθος εγγράφων } Τρία (3) ΙΧΦ αυτοκίνητα, κλειστού τύπου (βαν) } Πέντε (5) ΙΧΕ αυτοκίνητα } Μία (1) µοτοσικλέτα µεγάλου κυβισµού

Από το Μάιο 2014, ημερομηνία έναρξης λειτουργίας της Υπηρεσίας Ερευνών και Διασφάλισης Δημοσίων Εσόδων (Υ.Ε.Δ.Δ.Ε.), έως και το Δεκέμβριο 2016, εκτελούσε χρέη αναπληρωτή προϊστάμενου Διεύθυνσης και στη συνέχεια τοποθετήθηκε προϊστάμενος Διεύθυνσης στην εν λόγω Υπηρεσία, από την οποία μετακινήθηκε προκειμένου να αναλάβει τη θέση του Ειδικού Γραμματέα του Σώματος Δίωξης Οικονομικού Εγκλήματος (Σ.Δ.Ο.Ε.). Causes and control of illicit tobacco A research study conducted by Alvarez & Marsal Lawrence Hutter February 2018 Background to this research Tobacco products are among the most highly trafficked products in the world, second only to drugs. An estimated $40-$50 billion in tax revenues a year is being lost to the illicit trade: - $12 billion in the highest taxed European countries and approximately - $10 billion in the USA The composition of illicit trade has changed in recent years, exhibiting a significant shift from mainly contraband to counterfeit and illicit whites The debate about the relationship between high and increasing taxes on tobacco, illicit trade and organised crime crystallises around two core issues: - Relationship between tobacco tax policy, enforcement and illicit trade - Alleged involvement of the tobacco industry in illegal trade Alvarez & Marsal was retained by JTI to take an objective and independent view of the causes of illicit trade, based on the available evidence where it exists and drawing on the informed positions taken by governments, regulators and anti-tobacco activists. However, once differences in disposable income levels are taken into account and countries are grouped accordingly, a relationship between tax yield and illicit trade emerges. Overall, there is a 53% correlation between affordability and illicit consumption as a proportion of the total. This rises to 69% if Brazil and Latvia are excluded (which have very high levels of illicit trade due to supply side factors). There is a tipping point where a smoker switches to an illicit product - linked to affordability of the legal offering. The analysis shows that reductions in affordability have been primarily driven by retail price increases.

It appears that tax adjustments were not matched by investment in enforcement resulting in heightened illicit use. This contrasts significantly with pre-2012 illicit use, which was almost non-existent. This problem is further exacerbated when there is an absence of an effective enforcement regime. In Romania and Latvia, a rapid affordability decline in the late 2000s due to the need to comply with EU minimum excise rules led to very high levels of nonduty paid products. Source: various; A&M analysis Germany had big tax rises in which resulted in rapid growth of non-domestic duty paid (NDDP) products while a more gradual approach to taxation thereafter led to a stabilisation. In Spain, large tax increases during an economic crisis reduced affordability and resulted in a significant increase of NDDP products. 7 In Mexico, a 34% excise hike in 2011 resulted in a sharp increase in illicit trade. There is a clear link between the level of enforcement and the level of illicit trade as a % of total consumption - lower levels of enforcement tend to yield higher levels of illicit trade. Where affordability is pressured and/or enforcement is weak, higher levels of illicit trade occur. Where affordability is less pressured and enforcement stronger, lower levels of illicit trade result. Genuine EU sourced illicit product as a % of total EU illicit product, Source: KPMG Project Star/Sun, A&M Analysis 11 Accusations used today that the major tobacco companies benefit from illicit trade stem primarily from historical data During the period , agreements between the four major tobacco companies and the EU have reduced genuine EU sourced illicit product by approx. 75%. Major tobacco companies have no economic interest in illicit trade as it erodes or cannibalises volumes and profits from their legally sold products. Alleged involvement of the tobacco industry in illegal trade There have been some notable successes and the most effective are those where collaboration is most robust Conclusions The most effective solutions to tackle the illicit trade have involved collaboration and coordination between: - Government (fiscal policy, regulation, enforcement) - Health community (e.g., education campaigns) - Industry (intelligence, expertise) Pressure against government collaborating with the industry in the fight against illicit trade misrepresents FCTC Article 5.3 and is counterproductive: - The objectives of the FCTC Protocol to eliminate illicit trade in tobacco products and major tobacco companies are aligned - FCTC Article 5.3 does not prohibit governments from interacting with tobacco companies Notable AIT successes: 2015 & 16 JTI information led to the seizure of ~ 2 billion cigarettes globally. Imperial Brands helped law enforcement agencies seize 2.5 million kilos of illegal tobacco worth 375m and four illegal production lines. 12 High and increasing levels of tobacco taxation have been the principal catalyst for growth in the illicit trade, absent parallel strengthening of enforcement. Tax increases have been the main cause of increased pressure on the affordability of cigarettes with some affected consumers seeking alternative, more affordable and, if necessary, illegal products instead of quitting. Widely differing levels of tobacco taxes generate attractive profit opportunities for smugglers. The most effective solutions for tackling illicit trade involve: - Coordination and cooperation between government authorities and the legitimate tobacco companies - Reinvesting 1-2% of the potential additional tax revenues from tobacco tax increases in strengthened enforcement 13
