Indirect Tax update Issue 107 20 May 2015 Amendments to the Cyprus private yachts regime For any further clarifications you may have, please contact: Harry Charalambous Board Member Michael Grekas Senior Maria Anayiotou Senior Irene Lagou Mundi George Gregoriou Mamas Malais On 29 April 2015 the Tax Department published Circular 191 aiming at informing enterprises of a specific amendment made to the Cyprus private yacht regime (CYR). In particular, the amendment concerns the tables for determining the rates of use of recreational yachts within the European Union, as identified in Circular 181 of the Tax Department. (Circular 181 was published on 30 January 2014). According to Circular 181, output VAT on yacht leasing is accounted for and payable in the Republic only to the extent the leased yacht is used within the territorial waters of the European Union. For this purpose, the applicable rates for yacht under leasing within the European Union have been predefined based on their size and type of motion (motorized or sailing). Effective from 29 April 2015, the date Circular 191 came into effect, the tables for determining the applicable rates for recreational yachts under lease for use within the European Union have been amended. Specifically, the Tax Department proceeded with replacing the category of vessels with a length greater than 24 meters with three new sub-categories covering vessels of lengths 24,01-45 meters, 45,01 65 meters and over 65,01 meters respectively. As a result of this amendment, the CYR becomes even more attractive for registering private yachts in Cyprus, as the effective tax rate is reduced as low as 3,05%.

Συγκεκριμένα, η τροποποίηση αφορά τους πίνακες προσδιορισμού των ποσοστών χρήσης των σκαφών αναψυχής εντός της Ευρωπαϊκής Ένωσης, όπως αυτά καθορίστηκαν στην ερμηνευτική εγκύκλιο 181 του Τμήματος Φορολογίας (Η εν λόγω εγκύκλιος είχε δημοσιευτεί στις 30 Ιανουαρίου 2014). Σύμφωνα με την ερμηνευτική εγκύκλιο 181, επί της αξίας μίσθωσης σκάφους αναψυχής πρέπει να αποδίδεται ΦΠΑ εκροών στη ημοκρατία μόνο στην έκταση που το υπό μίσθωση σκάφος χρησιμοποιείται εντός των χωρικών υδάτων της Ευρωπαϊκής Ένωσης. Για το σκοπό αυτό έχουν προκαθοριστεί τα ποσοστά χρήσης των υπό μίσθωση σκαφών αναψυχής εντός της Ευρωπαϊκής Ένωσης με κριτήριο το μέγεθός τους σε συνδυασμό με τον τρόπο κίνησής τους (μηχανοκίνητο ή ιστιοφόρο). Με χρονική αφετηρία την 29 η Απριλίου 2015, οπότε και τέθηκε σε ισχύ η Ερμηνευτική Εγκύκλιος 191, τροποποιούνται οι πίνακες προσδιορισμού των ποσοστών χρήσης σκαφών αναψυχής που μισθώνονται για χρήση εντός της Ευρωπαϊκής Ένωσης. Ειδικότερα, το
Τμήμα Φορολογίας προχώρησε στην αντικατάσταση της κατηγορίας σκαφών με μήκος μεγαλύτερων των 24 μέτρων με τρεις νέες επιμέρους κατηγορίες οι οποίες αφορούν σκάφη μήκους 24,01-45 μέτρων, 45,01 65 μέτρων και σκάφη μήκους πέραν των 65 μέτρων αντίστοιχα. Ως αποτέλεσμα της εν λόγω τροποποίησης το ΚΣΑ γίνεται ακόμα πιο ελκυστικό για εγγραφή ιδιωτικών σκαφών στο Κυπριακό σχέδιο, καθώς ο φορολογικός συντελεστής μειώνεται μέχρι και στο 3,05%.
